Participant Safety Agreement and Liability Waiver

Acknowledgment of Risks and Waiver of Liability:

I, the undersigned participant, acknowledge that I have voluntarily chosen to participate in the open safari-style tour provided by Explore Monument Valley ("Company"). I understand and acknowledge that this tour involves inherent risks and dangers, including but not limited to the following:

Risks associated with traveling in a remote natural environment.

• Risks associated with wildlife encounters.
• Risks associated with uneven terrain and rugged conditions.
• Risks associated with inclement weather conditions.
• Risks associated with vehicle travel, including the possibility of accidents or collisions.

I understand that while the Company has taken reasonable precautions to ensure the safety of participants, it is impossible to eliminate all risks associated with the tour. I acknowledge that accidents and injuries can occur despite the Company's best efforts.

Waiver of Liability:

In consideration for being permitted to participate in the tour, I hereby waive, release, and discharge the Company, its owners, employees, guides, and affiliates from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my participation in the tour, including but not limited to negligence, breach of warranty, or strict liability.

I understand and agree that this waiver of liability includes, but is not limited to, any claims for personal injury, property damage, or wrongful death that may arise during or as a result of my participation in the tour.

Safety Regulations:

I acknowledge that the Company has established safety regulations for the tour, including but not limited to the requirement to remain seated at all times while the vehicle is in motion. I agree to comply with all safety regulations and instructions provided by the Company's guides and staff.

Assumption of Risk:

I acknowledge that I am voluntarily participating in the tour with full knowledge of the risks involved. I assume full responsibility for any risks, injuries, or damages that may occur during the tour, even if such risks, injuries, or damages are caused in whole or in part by the negligence or fault of the Company.

Indemnification:

I agree to indemnify, defend, and hold harmless the Company, its owners, employees, guides, and affiliates from any and all claims, liabilities, damages, or expenses, including attorney fees, that arise out of or are in any way connected with my participation in the tour.

Acknowledgment of Understanding:

I have read this waiver form carefully and fully understand its contents. I acknowledge that I am giving up substantial rights by signing this waiver, including the right to sue the Company for damages in the event of injury, death, or property damage.
